一直關心失德教師濫用職權貽害莘莘學子問題的全國政協副主席梁振英，昨晚再次在個人社交網站列出一個英國處理失德教師投訴機構Teaching Regulation Agency(TRA)將失德教師除牌的個案，要求本身是教協副會長的教育界立法會議員葉建源回應，TRA極之透明、以公開形式就失德教師相關投訴進行聆訊的手法。

梁振英列出的個案，牽涉一個名為Mr Philip Turner的前英國教師除牌個案；他指出，該個案判詞清楚說明 ：一，被投訴的教師的姓名和該教師任職的學校的名稱是公開的、二，證人的身份是保密的、三，言論自由不是辯解理由、四，只是轉發他人的帖文也不是辯解理由、五，「公眾利益高於教師個人利益」、六，被除牌的教師不僅終身被禁任教，而且不可申請恢復教職。

該案要點如下：

TRA對Mr Philip Turner曾在Facebook發表仇恨伊斯蘭教的言論以及在課堂上做出涉及種族歧視和仇恨的引導作除牌決定。

家長的投訴包括：

1. 在2017年8月到12月期間，Mr Philip Turner在其Facebook發帖，以及在2017年8月至2018年9月期間未能夠移除一個或多個貼文以及/或者圖片，這些貼文顯示出其對伊斯蘭教的人士以及與其不同國籍的人士缺乏包容和尊重。

2. 在一堂或多堂課上表達不合適的觀點，以及討論不合適的話題，向一個或多個學生暗示：

a. 在2018年7月13日左右，「所有的墨西哥人都是罪犯或是壞人」（ All Mexicans were criminals and/or bad）或類似的話；

b. 在2018年9月4日，如果一個少數族裔的人士對這個國家的政策不滿意，他們應該離開這個國家（leave the country）。

● 專業操守委員會(Professional Conduct Panel)調查發現：

1. 針對第一項指控：

- 證人證明該教師有問題的Facebook帖文是對公眾公開的，但當學校進行調查後，這些貼文就不再公開；

- 該教師有問題的貼文包括自己的評論，也包括轉發其他來源的帖文，包括：

◆轉發一個包含亞洲人的貼文，然後寫道：「再一次，英國女孩被沒有資格留在這個國家的人強姦了」（Mr Turner’s account shared a post which included pictures of Asian men and which stated: “Once again, British girls raped by men who have no right to be in this country…”）;

◆ 另外的評論寫道：「我們的言論自由政策意味著我們不能抨擊它」，附上照片寫著「下一個因為伊斯蘭教而喪生的人是誰？… 伊斯蘭教是世界的癌症，要切除掉」。（there was a separate comment stating “…our freedom of speech policy means we can’t actually speak against it. Vile vile vile religion”, with an image stating “Who’s going to die next because of Islam?...Islam is the cancer of the world. Cut it out!”）; 

◆ 另一個貼文寫道：「不要買按伊斯蘭教規屠宰的畜肉」（a separate post from Mr Turner’s account stated: “Do not buy muzzlim [sic] halal though”）

◆ 轉發一個此前發過的包含數個亞洲人圖像的貼文，寫道「更多的兒童性侵犯——他們都有什麼共同之處」（Mr Turner shared a previously posted article which contained a picture of a number of Asian men, with the comment: “More child rapists – wonder what they have in common?”）

◆ 一個貼文寫道：「我們在這個國家享受的言論自由意味著，如果我投票給一個右翼政黨，我將會失去工作。我最多投票給英國獨立黨（UKIP），這將為一些自由派瘋子帶來一些壓力」（“…the freedom of speech we enjoy in this country would mean if I voted or endorsed a right wing political party I would lose my job. UKIP is as far as I can go and that would be pushing it for some liberal loonies…”），Panel認為這個貼文顯示了Mr Turner個人真實的觀點

■ Mr Turner承認部分帖文是他發的，但部分是其他有他賬號權限的人發的，但小組認為他能夠看到這些他人在他賬號上發的貼文而沒有刪除，因此認為他需要為所有的有問題的帖文負責，因此認定第一項指控成立。

2. 對於第二項指控：

■ 曾在Mr Turner課上的證人指Mr Turner似乎在等「這樣的人應該離開這個國家」這個回答，並表現出對這個答案的認可。Witness B [REDACTED] commented that Mr Turner seemed to be waiting for the answer that the person could “leave the country”, and appeared to affirm that pupil’s opinion. This caused concern.

■ Panel認為對相應話題的討論本身沒有問題，但考慮到各項證據，Mr Turner允許學生在課堂上接受一方的觀念，而不是平衡觀點，因此認為第二項指控成立。Whilst the panel did not consider the respective topics of discussion were in themselves inappropriate, the panel determined, on the balance of the evidence before it, that Mr Turner had allowed pupils to take views of this nature from the classroom, rather than a balanced view of the issues at hand.

3. Panel的判定：

■ Panel認為Mr Turner犯下不可接受的專業失德（unacceptable professional conduct）以及令教師專業蒙羞的行為（conduct that may bring the profession into disrepute）。同時，在考慮是否給予較輕的處罰時，Panel認為公眾利益在Mr Turner利益之上，而Mr Turner缺乏自知和懺悔，這類極端的觀念傳授給容易受影響的學生，是導致這類觀念形成的重要原因，因此建議立即除牌。The panel decided that the public interest considerations outweighed the interests of Mr Turner. Mr Turner’s lack of insight and remorse throughout, and the risk of such extreme views being presented to impressionable pupils, were significant factors in forming that opinion. Accordingly, the panel made a recommendation to the Secretary of State that a prohibition order should be imposed with immediate effect.

■ 並且，由於Mr Turner的帖文顯示出不可接受的對其他種族和宗教缺乏包容，包括維持催生種族和宗教仇恨的冒犯性帖文。（an unacceptable lack of tolerance towards those of other nationalities or religions, including sustained offensive posts promoting racial and religious hatred），Mr Turner沒有認識到其行為對學生的影響以及公眾對教師專業的看法，在整個過程中也沒有顯示出懊悔，Panel因此建議不給予除牌決定設定期限（這將允許在2年後對除牌決定進行Review）

4. 最終決定：TRA最終決定禁止Mr Turner在任何學校任教，並且不可申請恢復教職（not be entitled to apply for restoration of his eligibility to teach）。
